Types of Personal Injury Cases
Michael Krutman handles all facets of personal injury work. This includes injuries resulting from automobile accidents, slip or trip and falls, work injuries, defective products and construction injuries.
What is a Slip and Fall Personal Injury Case
A slip and fall occurs when someone is injured as a result of someone else’s failure to keep their premises safe. For example, a store is required to keep the premises safe for their customers. This includes making inspections of their premises for any defects or dangers. So if there is a snow storm then the store must take steps to keep their premises and parking lot safe for potential customers.
Construction Injuries
A construction injury involves a worker suffering an injured at the job site. For example a client could be working for a subcontractor installing windows. If he is injured when doing his job, he will potentially have a Workers’ Compensation Claim. In addition, there may be a personal injury claim against the General Contractor if the jobsite was unsafe.
Auto Accidents as Personal Injury Cases
As part of his personal injury practice, Michael Krutman, Esquire has extensive experience representing clients who were injured in automobile accidents. This includes litigating and trying cases in Superior Court as well as negotiating settlements with the insurance companies.
The way that I handle that case is the person will get medical treatment. When they’re done treating I’ll then try to settle the case with the insurance company. If not I’ll file a lawsuit and we’ll proceed with discovery and eventually we’ll get a trial date. And all during that time period the case could settle at any time, could settle before the lawsuit, sometimes insurance companies won’t settle until after we file a lawsuit and sometimes cases don’t settle until the day of trial or sometimes we get a verdict.
If you’re involved in an auto, trucking, or motorcycle accident:
- Contact an attorney as soon as possible in order to preserve crucial evidence and conduct an early investigation.
- Seek medical care and preserve all medical documentation of your injuries.
- Don’t speak with the insurance company of the car that hit you until you consult an attorney.
- Don’t settle without consulting with an attorney. (Insurances companies will usually try to buy you off cheap.)
Don’t let the insurance company take advantage of you
If you’re injured in an auto or motorcycle accident because of a negligent driver, you need a skilled and experienced lawyer on your side. The negligent driver’s insurance company will do everything they can to reduce or avoid paying you on your claim. We’ll do everything possible to defend your rights and ensure justice is served. You’ll be guided through the complications that the insurance company will put you through – by an attentive, committed, and very experienced lawyer.
How to Recover for a Personal Injury Claim in an Auto Accident
In order to potentially recover for a personal injury claim when someone is injured in an automobile accident, the other driver has to be 50 percent or more at fault for a potential recovery. If a jury should find that the injured party is 51 percent or more at fault then we do not recovery anything. If a jury should find that both drivers are 50 percent at fault then the injured party would receive 50 percent of any verdict for the injuries suffered. If someone is stopped in traffic and then struck in the back the other driver would usually be 100 percent at fault. Also, if you are a passenger, fault is not an issue.
